Terms of service

1. Acceptance

By using bluefroganalytics.com (the site) or any product sold on it by BlueFrogAnalytics LLC ("we", "us"), you agree to these terms. If you do not agree, do not use the site or the products. BlueFrog Analytics, TagFrog and OpsBlu are brands of BlueFrogAnalytics LLC; opsblu.com has its own terms.

2. What we provide

• Free tools: on-demand checks of the public pages of a website you enter, including the Infrasight technology lookup.
• TagFrog: the tracking app for Shopify (WordPress to follow). Free tier on GA4; TagFrog Pro at $75/mo per store.
• Watch: weekly re-runs of the checks on one site with alerts on change, $19/mo per site.
• GTM container: a pre-made Google Tag Manager container you import and maintain yourself, $149 single store / $399 agency team, one-time, with 12 months of spec updates.
• Websites and Stores: a site built from a template for a one-time build fee plus a monthly fee for hosting, monitoring and changes by chat.
• Help by email: hourly engineering at $200/hr, email only, scoped in writing before any hour is billed.

We do not sell advertising, media buying, SEO, email marketing, creative or social media management, and nothing on this site is an offer of those services.

3. Accounts

Some products need an account. You are responsible for the accuracy of what you register, for keeping your sign-in private, and for what happens under your account. Tell us at once if you think someone else has access. We may suspend an account that breaks these terms.

4. Acceptable use

You agree not to:

• Run checks against a site in a way intended to harm it, or submit malicious URLs to the service.
• Script the free tools beyond the published rate limits.
• Reverse-engineer the checks, the Infrasight signatures or the TagFrog app.
• Resell check results as your own product. Sharing a result with your team, client or agency is fine.
• Use the site or a product to break any law.

5. Free checks

A free check reads publicly reachable pages of the URL you enter and reports what it finds. Results are informational. They are produced by automated analysis and are not professional advice; verify them before acting on them. By entering a URL you confirm you are allowed to have it checked. Our crawlers identify themselves and honour robots.txt, as described on the crawler page.

6. Payment, refunds and cancelling

• Prices are in US dollars and are the ones shown on the pricing page at the time of purchase. Payments go through Stripe.
• Subscriptions (TagFrog Pro, Watch, the monthly fee for a Website or Store) renew monthly until cancelled.
• Cancel in one click from the billing portal. The subscription runs to the end of the paid period and stops. There is no notice period.
• 14-day refund, no questions. Email hello@bluefroganalytics.com from the account address within 14 days of a charge and it is reversed. This covers subscriptions, the GTM container and the Website build fee (counted from launch).
• Help by email is billed for the hours used, never above the written cap, after the work is delivered.

7. Websites and Stores

• You supply the content and confirm you have the right to use it. We build from a template and you proofread before launch.
• The domain is registered to you, or transferred to you if we registered it. The code is a plain Astro project you can download at any time.
• The monthly fee covers hosting, HTTPS, Watch, the TagFrog free tier and small changes by chat. Larger changes are quoted separately in writing.
• When the monthly fee stops, hosting, monitoring and changes stop; the files, the domain and the content remain yours.
• Agencies may resell Websites and Stores under their own name at partner pricing through the OpsBlu Agency plan; the agency is our customer and sets its own terms with its client.

8. Ownership

The checks, the Infrasight data, the TagFrog software, the container templates, the site templates and the content of this site belong to BlueFrogAnalytics LLC. A GTM container you buy is licensed to you for the stores covered by the tier you bought. A website we build for you is yours: the content, the domain and the code of your project.

Your data stays yours. We claim no ownership of your website, your store data or your analytics.

9. Disclaimers

The site and the products are provided "as is" and "as available", without warranty of any kind, express or implied, including merchantability, fitness for a particular purpose, accuracy of results, or uninterrupted service. Ad platforms, analytics vendors and store platforms change their rules; we keep the products current but cannot promise a third party's conduct.

10. Liability

To the fullest extent the law allows, BlueFrogAnalytics LLC is not liable for indirect, incidental, special, consequential or punitive damages, including lost profits, lost data or lost business, arising from the site or the products. Our total liability for any claim is limited to what you paid us in the 12 months before the claim.

11. Indemnification

You agree to indemnify BlueFrogAnalytics LLC against claims, damages and costs that arise from your breach of these terms or your misuse of the site or the products.

12. Termination

You can close an account at any time from the billing portal or by email; we delete its data as described in the privacy policy. We may suspend or end access for a breach of these terms, with notice where practical.

13. Changes

We may change these terms. The current version is always on this page with its date. For a material change we email account holders. Using the site or a product after a change takes effect means you accept it.

14. Governing law

These terms are governed by the laws of the State of Oregon, United States, without regard to its conflict of law rules. Disputes are heard in the state or federal courts located in Oregon.
